Terms of Service

These Terms of Service ("Terms") govern your use of www.md-factor.com (the "Site") and any purchase of MD® products through the Site. The Site is operated by La Canada Ventures, Inc. ("MD®", "we", "us", or "our"). By using the Site or placing an order, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a legally binding contract to use the Site or place an order.

2. Products & Pricing

• MD® products are physician-formulated, non-drug personal care products. They are cosmetics or dietary supplements (as applicable) and are not intended to diagnose, treat, cure, or prevent any disease.
• All prices are shown in U.S. dollars unless otherwise indicated and are subject to change without notice. We make every effort to keep pricing and product information accurate; in the event of a pricing or description error, MD® reserves the right to cancel or refuse the order and issue a full refund.
• Promotional discounts and bonus gifts are limited to one per order unless otherwise stated, and cannot be combined.

3. Orders, Payment & Authorized Resellers

• Orders are subject to acceptance by MD®. We may decline or cancel any order at our discretion, including for suspected fraud, address issues, or inventory limitations.
• Authentic MD® products are sold exclusively through www.md-factor.com and the brand's own Amazon storefront. The MD® product warranty, satisfaction guarantee, and return policy apply only to products purchased through these authorized channels.
• Products purchased from unauthorized resellers, third-party marketplaces, or other websites are not covered by MD® warranty or return policy.

4. Auto-Delivery Subscriptions

Auto-Delivery subscriptions are governed by our Subscription & Cancellation Policy. You may cancel at any time with no cancellation fee.

5. Returns & Refunds

All returns and refunds are governed by the MD® Refund & Return Policy. Returns must be initiated within 30 days from the ship date; only unopened, unused products in original sealed packaging are eligible. Refunds are credited to the original payment method, minus original shipping and handling.

6. Shipping & Delivery

Shipping is governed by the MD® Shipping & Delivery Policy.

7. Satisfaction Guarantee

• Where MD® offers a money-back satisfaction guarantee on a specific product, the offer is limited to one guarantee-related refund per purchaser over the purchaser's lifetime.
• The guarantee applies only to products purchased from authorized MD® channels and used as directed for the period specified on the product page.
• MD® reserves the right to invalidate the guarantee policy, retroactively if necessary, in cases of suspected fraud, abuse, or misuse.

8. Intellectual Property & Trademarks

MD®, MD Factor®, MD Lash Factor®, MD Hair™, MD Skin™, and MD Wellness™ are trademarks owned by La Canada Ventures, Inc. All Site content (text, images, logos, product names, formulation descriptions, video, and code) is the property of La Canada Ventures, Inc. or its licensors and is protected by U.S. and international intellectual property laws. You may not copy, reproduce, modify, distribute, scrape, or create derivative works from any Site content without prior written permission, except as permitted by applicable copyright exceptions and fair use.

9. Patents

Select MD® products are protected by U.S. Patent No. 8,206,695 and other patents pending. Unauthorized use of patented formulations is strictly prohibited.

10. User Submissions & Reviews

If you submit a product review, photo, video, testimonial, or other content to the Site, you grant MD® a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, modify, and display the content in connection with MD® marketing. You represent that you own or have the right to grant this license and that the content is accurate and does not violate any law or third-party rights.

11. Disclaimers & Limitation of Liability

• Site content is provided "as is" without warranty of any kind, express or implied. Statements regarding MD® products have not been evaluated by the U.S. Food and Drug Administration and are not intended to diagnose, treat, cure, or prevent any disease.
• To the maximum extent permitted by law, MD® and La Canada Ventures, Inc. are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Site or MD® products. Total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless MD®, La Canada Ventures, Inc., and our officers, directors, employees, and agents from any claim arising out of your breach of these Terms or your misuse of the Site or products.

13. Governing Law & Disputes

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site shall be brought in the state or federal courts located in San Mateo County, California, and you consent to the exclusive jurisdiction of those courts.

14. Changes to These Terms

MD® may update these Terms from time to time. Material changes will be reflected on this page with a revised effective date. Your continued use of the Site after a change indicates acceptance of the updated Terms.
